If the Court finds you to be guilty of the offence of failing to provide a specimen of breath, it can attract a sentence of up to 6 months imprisonment, up to £5000 fine and a minimum disqualification of 12 months.

The offence is not as well advertised as driving with excess alcohol, with many motorists being unsure of the possible penalties despite it being a very serious offence.

If you are stopped by the police on suspicion of being over the legal limit you will be asked to complete a breath test.  If you fail or refuse to complete this procedure, either at the roadside or in a police station, then you can be charged and put before the Court for an offence of failing to provide a specimen of breath.
