Our client was accused of theft of alcohol from a garage whilst also purchasing credit for an electric card. Evidence was called during the Trial that confusion arose in the crediting of the card leading to her waiting at the till for 10 minutes during which time she took the alcohol from the till and placed it in a bag. When all the factors were put before the Magistrates they properly acquitted her of the charge.
