Possession with intent to supply Section 5(1) of the Misuse of Drugs Act 1971

My client was an individual who, by being naïve, took possession of a large quantity of cannabis for safekeeping. The cannabis was valued at £3,500 to £4,500. At the time of the offence my client was living with in a small one bedroomed flat with his girlfriend.

The Police raided the flat and arrested both him and his girlfriend. The cannabis was seized as was £200 found in the flat. She had no direct involvement but due to the size of the flat she could not readily say that she had no knowledge of the cannabis being stored there. We submitted a prepared statement declaring his involvement during the Police Station interview. Both were charged but the case against his girlfriend was discharged pre- committal and he appeared in the Crown Court alone.

He pleaded guilty to Possession with intent to supply and was sentenced to a 4 month custodial sentence however this was suspended for a period of 12 months. No application was made under the Proceeds of Crime Act and he received the £200 back seized on his arrest.
