Violent Disorder – Section 2
Violet Disorder offences are amongst the more serious of the Public Order offences and the penalties can be equally as serious, often resulting in the imprisonment of the offenders.
Violent Disorder is when three or more persons who are present together use or threaten unlawful violence and the conduct of them (taken together) would cause a person of reasonable firmness present at the scene to fear for their personal safety.
In a scenario such as this, all three parties (who are using/threatening unlawful violence) are guilty of violent disorder.
These offences can be processed in either the Crown Court or Magistrates Court, depending on the circumstances and finer details of the case.
